What is a progression appeal?
There are some instances where King's may remove students from their programme of study for failure to make sufficient academic progress, which means that the student's registration will be terminated.
If you've received notification of your results and have not passed enough credit to progress to the next year of study, please do not complete a progression appeal form. Instead, read our article How can I make an academic appeal? for guidance on how to make an academic appeal.
How can I make an appeal?
If you would like to make an appeal against the decision to terminate your studies, you must submit a Academic Progress Appeal Form to Student Conduct & Appeals within 10 working days of the written notification of removal.
In accordance with the Academic Regulations, the Principal will allow your appeal to be heard, if they are satisfied that one or more of the following grounds are met:
- That new information is to hand which could not have been made available for consideration by the Faculty at or before the time the decision to remove was taken, and sufficient evidence remains that the appeal warrants further consideration;
- There is evidence of significant administrative or procedural error, including error relating to sufficient written notice to the student and student compliance with the conditions of written notice, made at or before the time the decision to remove was taken, and sufficient evidence remains that the appeal warrants further consideration;
- There are other grounds considered applicable by the Principal, including compassion.
What happens if the criteria for an appeal have been met?
An Appeal Committee will be convened; you should normally receive 10 working days’ notice of the hearing and will be invited to present your case to the panel.
What happens during a committee hearing?
During a hearing, the Committee will determine whether there is sufficient reason to challenge the original decision to withdraw.
Where it concludes that such reason is present, the committee can override the original decision and replace it with one of its own or refer the case back to your faculty with commentary for reconsideration.
The decision will normally be communicated to you and any relevant staff member(s) within 5 working days of the decision.
What happens if the criteria for an appeal have not been met?
If the criteria for an appeal have not been met, your appeal will be dismissed. This decision will normally be communicated within 30 working days of receipt of the appeal.
What can I do if I am dissatisfied with the outcome of appeal?
When all internal procedures are complete, you may request an independent review of your case by the Office of the Independent Adjudicator for Higher Education (OIA) should you be dissatisfied by the university’s final outcome.
The Office of the Independent Adjudicator for Higher Education (‘OIA’) is an independent body set up to review student complaints. It is free for students and deals with individual complaints against Higher Education Institutions in England and Wales.
Provided your complaint is eligible under the rules of the OIA's complains scheme, the OIA will look at whether King's has applied its regulations properly and followed its procedures correctly. It also considers whether any decision made by the King's was fair and reasonable in all the circumstances.
